Notice and Takedown Policy

OKC Unleashed respects intellectual-property rights and follows the U.S. Digital Millennium Copyright Act (DMCA) safe-harbor rules set out in 17 U.S.C. § 512, as well as the spirit of the EU e-Commerce Directive’s hosting-provider provisions for overseas visitors. This page explains how copyright owners can ask us to remove or disable allegedly infringing material hosted on okcunleashed.com, and how users can submit a legally valid counter-notice if they believe the material was taken down in error.

Scope

This procedure applies to any image, video, text, PDF, or other file stored on our servers—including student hand-outs and before-and-after grooming photos—that is claimed to infringe a copyright the claimant owns or controls. It does not cover defamatory, privacy-violating, or trademark complaints, which should be addressed to legal@okcunleashed.com.

How to Send a Valid DMCA Notice

To receive protection under the DMCA’s safe harbor, a takedown notice must include the six elements listed in 17 U.S.C. § 512(c)(3) (A)–(F):

  1. Your physical or electronic signature.

  2. Identification of the copyrighted work you believe is infringed (title, URL, ISBN, etc.).

  3. Exact location of the material on our site (full URL or direct link).

  4. A statement of good-faith belief that use of the material is not authorised by the owner, agent, or law.

  5. A statement, under penalty of perjury, that the information in your notice is accurate and you are the copyright owner or authorised to act on the owner’s behalf.

  6. Your contact information (name, address, phone, and e-mail).

Incomplete or vague notices may be rejected or require clarification.

Our Response Timeline

  • We will acknowledge receipt of a compliant notice within five business days and temporarily disable access to the material or the entire page while we investigate.

  • If the notice is facially defective (missing a required element), we will inform the sender and request a corrected version.

  • We will notify the affected user or content uploader of the takedown and provide a copy of the notice.

Counter-Notice Procedure

If you believe your material was removed by mistake or misidentification, you may file a counter-notice in accordance with 17 U.S.C. § 512(g)(3). Your counter-notice must include:

  1. Your physical or electronic signature.

  2. Identification of the material removed or to which access was disabled and its prior location.

  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.

  4. Your name, address, phone number, and consent to the jurisdiction of the U.S. Federal District Court for the Western District of Oklahoma, plus acceptance of service of process from the complainant.

Email the counter-notice to dmca@okcunleashed.com. We will forward it to the original claimant. Unless we receive notice of a court action within 10–14 business days, we may restore the content.

Repeat - Infringer Policy

Consistent with § 512(i) and recent case law, we operate a zero-tolerance plan for wilful repeat infringers. A user who receives three valid takedown notices in any 12-month period will have their upload privileges—and, if applicable, academy portal login—terminated. We also reserve the right to terminate after fewer notices in egregious cases.

Misrepresentations

Under 17 U.S.C. § 512(f), anyone who knowingly makes false claims in a notice or counter-notice may be liable for damages, including costs and attorneys’ fees. Think carefully before you submit.

International Users

Visitors from jurisdictions governed by the EU e-Commerce Directive can submit infringement notices that meet local requirements; we will process them in broadly the same way described above.

Changes to This Policy

We review the Notice and Takedown Policy annually and whenever copyright law or platform practices evolve. Material changes appear on this page with a new “Last updated” date. Continued use of the Site after changes go live means you accept the revised policy.
